Terms and Conditions

This document outlines the Terms and Conditions governing photography and videography services provided by Munchier Photography (“Studio”). This Agreement constitutes the entire understanding between Munchier Photography and the Client, superseding all prior verbal or written agreements. Any modification to this Agreement must be made in writing and signed by both parties.

In this Agreement, “Photographer” refers to Ramon Rodriguez, trading as Munchier Photography, and “Client(s)” refers to the person(s) booking or participating in the session or event.

Booking and Payments

All package prices are as stated at the time of booking and remain fixed once confirmed.

A non-refundable 50% retainer is due at the time of booking to reserve your date and time.

Full payment must be made at least five (5) days prior to the event or session. Failure to pay in full by this deadline will result in cancellation of services, and Munchier Photography staff will not attend the event or session.

Upon payment, Munchier Photography reserves the agreed-upon time and will not accept other bookings for that slot.

All payments are non-refundable except in the event of cancellation by Munchier Photography.

Accepted payment methods include cash, CashApp, Zelle, Venmo, or card. Checks should be made payable to Ramon A. Rodriguez.

Client Cooperation and Conduct

Clients agree to maintain a positive attitude, communicate effectively, and cooperate fully to achieve the best results.

Munchier Photography is not responsible for missed shots or limited coverage due to lack of cooperation, lateness, or non-compliance by participants.

Any threats, unsafe conditions, or inappropriate behavior toward the Photographer or equipment will result in immediate termination of services with no refund.

Session Fees

The session fee covers:

The Photographer’s time, artistic direction, and creative expertise.

Basic retouching and editing of images as determined by the Photographer.

Delivery of a curated selection of edited images via a private gallery.

Additional retouching, prints, or digital files may be purchased separately. All goods remain the property of Munchier Photography until paid for in full.

Location Fees and Travel

Clients are responsible for all fees associated with their chosen location (permits, admission, parking, etc.).

Travel within 45 minutes of Orlando, FL 32812 is included. Locations beyond this radius incur a $0.52 per mile fee at the Photographer’s discretion.

Rescheduling and Cancellations

Clients may reschedule at least 24 hours in advance without penalty.

Failure to provide 24-hour notice or a no-show forfeits the session and payment.

Munchier Photography reserves the right to reschedule due to illness, weather, equipment failure, or circumstances beyond its control.

Re-Shoots and Refunds

Re-shoots are granted solely at the Photographer’s discretion and will not be issued for:

Poor clothing, hair, or makeup choices.

Uncooperative subjects or lack of preparation.

Weather conditions or failure to follow the Photographer’s guidance.

Archive and Image Storage

Images are stored for up to twelve (12) months after the session.

Munchier Photography is not responsible for data loss or damage due to circumstances beyond its control.

Re-uploads of archived sessions (if available) incur a $50 re-archive fee.

Damage and Delivery

Munchier Photography is not responsible for damage to portraits after delivery, including during shipment.

Clients assume all responsibility for product care upon receipt.

Model Release

Clients grant Munchier Photography the irrevocable right to use, reproduce, and publish any images taken for portfolio, advertising, website, social media, or promotional purposes.

No monetary compensation shall be provided.

Clients wishing to opt out must do so in writing before the session.

Poses and Nudity – Limit of Liability

Munchier Photography may photograph or film subjects who are clothed, partially clothed, or nude, depending on the project’s creative scope.

The model acknowledges and agrees to:

Clearly communicate personal boundaries, comfort levels, and preferences before and during the session.

Immediately inform the Photographer if they wish to stop, adjust a pose, or change their level of comfort.

Understand that posing may involve light physical direction (e.g., adjusting garments or posture) strictly for composition and not of an inappropriate nature.

The Photographer maintains a professional environment and reserves full creative control during the session.

The model releases Munchier Photography and its associates from all claims or liabilities arising from participation in such sessions, including accidental contact or physical strain caused by posing or movement.

Liability

Munchier Photography is not liable for injuries sustained during sessions or on location.

Clients are responsible for their own safety and that of accompanying individuals, including children.

Copyright and Usage

Munchier Photography retains full copyright of all images.

Clients are granted a personal-use print release only. Commercial use, reproduction, or editing without written consent is prohibited.

Unauthorized use or alteration of images may result in legal action and billing for each image at current digital rates.

Session Conduct and Punctuality

Sessions begin at the scheduled time. Clients are encouraged to arrive 15 minutes early for preparation.

Late arrivals may result in reduced shooting time with no adjustment in fee.

Newborn Photography

Newborn sessions should ideally take place within 2–3 days after birth for best results.

Parents must contact Munchier Photography promptly after birth to finalize scheduling.

In case of illness, weather, or personal conflicts, sessions may be rescheduled at the Photographer’s discretion.

Newborn sessions must be rescheduled within one week of the original session date to avoid forfeiture of the booking fee.

The Photographer prioritizes safety and reserves the right to end or adjust poses if a newborn becomes unsettled or at risk.

Parents are responsible for the safety and supervision of their child at all times.

Display and Promotion

Munchier Photography may use images for its website, portfolio, exhibitions, social media, and commercial materials.

Discretion will always be used regarding content sensitivity.

Clients will not receive compensation for such use but may request the removal of specific images from public display.

Force Majeure and Limitation of Liability

In the unlikely event of illness, accident, equipment failure, or other force majeure event, Munchier Photography’s liability is limited to the return of all monies paid.

Munchier Photography is not responsible for circumstances beyond its control, including weather, venue restrictions, or natural disasters.

Acknowledgment

By booking a session or event with Munchier Photography, the Client acknowledges that they have read, understood, and agreed to all Terms and Conditions contained herein.
